business valuation

Business valuation is a process and a set of procedures used to estimate the economic value of an owners interest in a business, much of which is determined by a CPA. Valuation is used by financial market participants to determine the price they are willing to pay or receive to consummate a sale of a business.


Expert witness

An expert witness is a witness, who by virtue of education, training, skill, or experience, is believed to have knowledge in a particular subject beyond that of the average person, sufficient that others may officially (and legally) rely upon the witness's specialized (CPA) opinion about an evidence or fact issue within the scope of their expertise, referred to as the expert opinion. As an expert witness, he has specializations that include forensic accounting and litigation support services. Wrongful termination

Wrongful dismissal, also called wrongful termination or wrongful discharge, is an idiom and legal phrase, describing a situation in which an employee's contract of employment has been terminated by the employer in circumstances where the termination breaches one or more terms of the contract of employment. A CPA might be involved in defense of an employer or employee in a wrongful termination lawsuit.


Breach of contract

Breach of contract is a legal concept in which a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other party's performance. A material breach is any failure to perform that permits the other party to the contract to either compel performance, or collect damages which could be determined by a CPA.


Patent infringement

Patent infringement is the act of utilizing a patented invention without permission from the patent holder. Permission may typically be granted in the form of a licence, sometimes where a CPA has been involved in setting up an arrangement for payment. In many countries a use is required to be commercial (or to have a commercial purpose) to constitute a patent infringement.


Product liability

A business that has to close down completely while the premises are being repaired due to a business interruption may lose out to competitors. A quick resumption of business after a disaster is essential. A CPA can help prepare you for a business interruption as well as helping you prepare for the correct amount of insurance. If you were involved in a business liquidation, a CPA would be a valuable asset and he could function as an insolvency accountant, if the need arises. An insolvency accountant is usually a CPA and can function in either a business interruption situation or in a business liquidation. There have also been cases where a personal injury claim calculation is needed to satisfy any partnership disputes.
